In Pennsylvania, temporary legal custody of a child can be transferred from a parent, legal guardian, or other custodian,
if a child is found by the courts to be a "dependent child". This bill adds to the definition of a dependent child as follows:
The definition of "dependent child" in section 6302 of Title 42 of the Pennsylvania Consolidated Statutes is amended to read:
§ 6302. Definitions. The following words and phrases when used in this chapter shall have, unless the context clearly indicates
otherwise, the meanings given to them in this section: "Dependent child." A child who:...(11) is a newborn and receives a diagnosis of fetal alcohol syndrome or tests positive for any amount of an illegal controlled
substance, unless the child tests positive for a controlled substance as a result of the mother's lawful intake of such substance
as prescribed.
